More than 200 physicians nationwide took the exam, and the first certificates are expected to be issued in January, said Dr. Gail McGuinness, executive vice president of the pediatric board. McGuinness said child abuse pediatricians will be able to consult on complicated cases, teach the discipline in medical schools and advance research in the area. Cook County Public Guardian Robert Harris, whose office represents thousands of state wards in juvenile court, said the change is a leap forward in protecting the state's most vulnerable children. "There have been instances where people not familiar with child abuse miss (it). If they had someone on staff that had that kind of specialty, they may not have missed it," Harris said. During her hospitalization in anticipation of J.M.G.'s delivery, V.M. demonstrated combative and erratic behavior including a refusal to consent to a cesarean section (c-section)¹. Despite the medical opinion that the fetus demonstrated signs of distress and that the procedure was necessary to avoid imminent danger to the fetus, the child was born by vaginal delivery without incident. After the birth of the child, plaintiff Division of Youth and Family Services (DYFS) investigated. It learned of V.M.'s refusal to consent to the c-section and discovered that V.M. had been under psychiatric care for twelve years prior to J.M.G.'s birth. Moreover, V.M. was not forthcoming about her treatment or diagnosis. B.G. also refused to cooperate with DYFS's efforts to obtain information. DYFS commenced a Title 9 proceeding pursuant to the Abandonment, Abuse, Cruelty and Neglect Act (the Act), N.J.S.A. :6-8.21 to -8.106, and placed J.M.G. in its custody. At the fact-finding hearing, the trial judge found that J.M.G. was an abused and neglected child due in part to her parents' failure to cooperate with medical personnel at the time of her birth. _________________________________________________________________ ¹ A cesarean section is an operative procedure involving an "incision through the abdominal wall and the uterus (abdominohysterotomy) for extraction of the fetus." Так могут в Америке явочным порядком отобрать детей за причинение им эмоциональных страданий, без следов или подозрений угрозы жизни, голода, побоев, изнасилований и проч.? Или всё-таки не могут? Полного ответа не сможет дать никто, а я даю ответ частичный. Итак: в графстве Освего, штат Калифорния, после июня 2002 года -- не могут. Именно тогда ихнее CPS проиграло подходящий суд. While unrelated, the ruling came amid scrutiny of the state's removal of hundreds of children in April from the Fundamentalist LDS Church's YFZ Ranch. "The decision will require us to make some extremely difficult decisions," Carey Cockerell (см. фото), commissioner of the Texas Department of Family and Protective Services, said in an "urgent legal advisory." The ruling means child welfare workers will also be required to obtain court orders in most cases before removing allegedly abused children from their homes, officials said. The advisory memo was sent last week to CPS staff, the Houston Chronicle and San Antonio Express-News reported Tuesday. The intense attention it got in the press led to creation of the first Society for the Prevention of Cruelty to Childern, in New York City. Such societies were quickly established all over the United States. By 1906 there were 240 SPCCs or Humane Societies—which concerned themselves with cruelty to both children and animals—nationwide. Often, they were known to their victims simply and appopriately as "the Cruelty". The groups were given the same sort of broad powers to investigate families and seek the removal of their children as is given to Child Protective Services today—with remarkably similar results: —When the broad power they had wasn't enough, they bent or broke the law. Gordon writes that when agents of the Massachussetts SPCC couldn't get into a home legally, "they climbed windows. They searched without warrants. Their case notes frequently revealed that they made their judgements first and looked for evidence later... As one annual report put it delicately: It is true that we have taken risks on the margin of legal liability which seemed needful to rescue the child...but without cost to sciety...If `indiscreet zeal' which is made such a bugbear occasionally leads us into mistakes, the public will condone the error ... much more readily than they would approve the opposite fault of timidity or lukewarmness in cases of well-ascertained cruelty." She turned around to see her other 8-month-old trying to push herself up from the floor, where she'd been playing, and knock her head. After she began throwing up and drifting off to sleep, her parents grew concerned, called the doctor and ended up at Children's Hospital. The baby recovered fully within 24 hours. With lights flashing and four police officers on hand, social workers arrived at the Caplan house at midnight on the night after the baby entered the hospital. They took the infant's uninjured sister out of her father's embrace and put her in foster care in Prince George's County. It was the first night she had ever spent away from her parents and her sister. It would not be the last. She was forced to spend nearly two weeks at the foster care facility in Hyattsville. The injured sister, after her recovery, was kept in the hospital awaiting test results. Afterward, she was in foster care for five days. Both sisters were then reunited at home under their grandmothers' care, but on condition that the Caplans move out of their own house. They wiped out their savings and borrowed from relatives to raise $75,000 for legal help. "This family is privileged and able to marshal significant resources to accomplish its goals and fight the allegations," CFSA head Sharlynn Bobo wrote to her staff in September. Или, как отомстить ушедшему мужу: GALENA, Md. - State police arrested a couple Friday in connection with a child abuse and drug investigation after a juvenile family member's MySpace account claimed the couple had given her drugs. Richard Bland, 29, and Diana Bland, 23, both of the 32700 block of Galena Sassafras Road, were charged with two counts of child abuse and one count of contributing to delinquent conditions of a minor. According to police, Richard Bland's 12-year-old daughter had traveled to Maryland from Florida to visit for the holidays and was allegedly given cocaine and marijuana on a number of occasions by both suspects. After returning to Florida, the girl wrote about the drug usage on MySpace and then told her mother about the incident. Her mother then contacted police. The court's ruling said that schools represent society, and "it was in the children's interest to become part of that society. Jessica Durham was photographed allowing her toddler Michala to suck from a marijuana water pipe, also known as a bong, in 2004 by a friend upset about the activity. In 2005, a lower court sentenced Durham to five years in prison for unlawful marijuana distribution. In its ruling on Friday, a three-judge panel of the 9th Circuit upheld the conviction but said the sentence exceeded the applicable federal law which calls for punishment of no more than two years in prison. Amanda Lynn Livelsberger, 30, pleaded guilty to several charges this week and will be sentenced Nov. 27. The boy told police that he was required to do his homework as soon as he got home from school, and then was allowed to smoke marijuana with his mother, according to court documents.
